1. Acceptance of Terms
These Terms of Service ("Agreement") govern your use of the JumpIn Pitt mobile application ("App"), the website at jumpinpitt.com (the "Website," including the no-download member-redemption pages such as jumpinpitt.com/redeem), and all related services (collectively, the "Services"), operated by JumpIn Pitt, LLC, a Pennsylvania limited liability company ("JumpIn Pitt," "we," "us," or "our"). By downloading, installing, or using the App, by accessing the Website, or by scanning a JumpIn Pitt member QR code and completing the verification flow, you agree to be bound by this Agreement and by our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the Services.
For purposes of Sections 14, 15, and 16 below, "Protected Parties" means JumpIn Pitt, LLC and its parent entities, subsidiaries, affiliates, and each of their respective founders, members, principals, owners, managers, directors, officers, employees, contractors, agents, advisors, and licensors.
2. Eligibility & Age
You must be at least 13 years old to use the Services. By using the Services, you represent that you meet this requirement. If you are under 18, you represent that a parent or guardian has reviewed and agreed to this Agreement on your behalf. The Services may surface venues that serve alcohol or are restricted to patrons of legal drinking age; nothing in the Services authorizes anyone under 21 to purchase or consume alcohol, and all such purchases remain subject to applicable law and the venue's own policies.
3. Account Registration & Security
You may browse much of the App without creating an account. An account is required for features that depend on your identity, including check-ins, passport stamps, reviews, saved lists, the leaderboard, points, and verified-member discount redemption.
To create an account you must provide a valid phone number. Authentication is performed via a one-time passcode (OTP) sent by SMS to your phone. You may optionally provide an email address, set a display name, and upload a profile photo. You are responsible for keeping your device and phone number secure and for all activity that occurs under your account. You may not share your account, allow others to access it, or create an account using false information or another person's identity. Notify us immediately at support@jumpinpitt.com if you suspect unauthorized use.
You may permanently delete your account and associated personal data at any time from the Profile screen by tapping "Delete Account." This action is irreversible.
SMS Messaging Terms
By providing your phone number, you agree to receive a one-time passcode (OTP) by SMS to authenticate your account and to verify your visit when you redeem a member offer. If you separately opt in to marketing messages (for example, by checking the optional "giveaways & offers" box on a redemption page), you also consent to receive promotional messages; that opt-in is optional and is not a condition of using the Services.

- Rates/Frequency: Message and data rates may apply. Verification message frequency is approximately 1 per login or redemption attempt.
4. Acceptable Use
You agree to comply with all applicable local, state, and federal laws in connection with your use of the Services. You may not:
- Use the Services for any unlawful purpose or in violation of any applicable law or regulation
- Scrape, crawl, harvest, or copy Service content by automated means
- Sell, sublicense, lease, or transfer your access rights
- Circumvent, disable, or interfere with security or rate-limiting features, or attempt to gain unauthorized access to any system or account
- Impersonate another person, misrepresent your affiliation, or provide false information
- Submit fraudulent check-ins, reviews, redemptions, or points activity, or otherwise manipulate the leaderboard, passport, or discount mechanics
- Upload or transmit content that is unlawful, defamatory, harassing, hateful, obscene, infringing, or otherwise objectionable (see Section 5)
- Use the Services to transmit spam or unsolicited communications
Passport stamps, points, and leaderboard standing are awarded for personal tracking and engagement only, have no monetary value, and are not redeemable for cash. We reserve the right to modify, withhold, or remove check-in records, points, reviews, or other activity in cases of suspected abuse, fraud, or system error.
5. User-Generated Content
The Services let you submit content, including venue reviews and feedback, selectable "vibe" tags, a display name, and an optional profile photo (collectively, "User Content"). You retain ownership of your User Content.
License you grant. By submitting User Content, you grant JumpIn Pitt a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to host, store, reproduce, modify (for formatting and display), publish, and display that User Content in connection with operating, promoting, and improving the Services. For example, selected "vibe" tags may be aggregated and displayed on venue pages, and public review text you choose to post may be carried to the relevant venue's Google listing through the in-app review flow. Private feedback you mark as private is routed to the venue (or, as a fallback, to JumpIn Pitt support) and is not posted publicly through the App.
Your responsibility. You represent that you own or have the necessary rights to the User Content you submit and that it does not violate this Agreement or any third-party right. You are solely responsible for your User Content.
Content screening. Free-text fields, including review and feedback text and display names, are passed through an automated profanity and objectionable-content filter at the time of submission, and submissions that fail are rejected. This automated screen is a first-pass measure and is not a guarantee that all objectionable content is caught or removed.
Reporting & moderation. You can report inappropriate names, offensive content, or other issues from within the App (for example, from the Profile screen), and reports are reviewed by our team. We may, but are not obligated to, review, moderate, refuse, or remove any User Content, and we may suspend or terminate accounts that repeatedly or egregiously violate this Agreement.
Removal. We may remove or restrict User Content at any time, with or without notice, at our sole discretion. You may remove your own User Content where the App provides controls to do so, and deleting your account removes associated User Content from the App as described in Section 3, although content you chose to post to a third-party platform (such as a Google review) is governed by that platform and is outside our control.
6. Partner / Venue Participation
Venues may participate in the Services as partners ("Partners"). Approved Partners can use the in-app portal to post and manage content about their own venue, including recurring specials and deals, one-off dated events, menus and menu photos, hours, parking, booking links, and similar venue information ("Partner Content"). Partner Content is provided by the Partner; while we curate certain editorial elements of venue listings, we do not independently verify all Partner Content and make no representations about its accuracy or completeness.
Tickets and reservations are link-outs. Where a Partner or event includes a ticket link or a reservation link, tapping it sends you to a third-party platform (for example, an event ticketing site or a restaurant reservation provider). JumpIn Pitt is not a party to, and takes no payment or commission on, any ticket, reservation, food, beverage, or other transaction between you and a venue, event organizer, or ticketing or reservation platform. Those transactions are solely between you and the third party and are governed by that third party's own terms.
Member discounts. Certain venues may make a verified-member discount available, which you unlock by completing the in-app or QR verification flow and then present to venue staff. The discount is honored and applied by the venue at its own point of sale; JumpIn Pitt does not process the payment, collect the discount amount, or guarantee that any particular discount will be available, honored, or applied. Participation, discount amounts, and availability may change or end at any time.
Partner participation is subject to approval and to a separate agreement between JumpIn Pitt and the Partner. Partners are responsible for ensuring their Partner Content is lawful, accurate, and that they have the rights to any material they upload, and Partners grant JumpIn Pitt the same display license described in Section 5 for the content they post. JumpIn Pitt may accept or decline partnership requests, and may edit, refuse, or remove Partner Content, at its sole discretion.
7. Location Services
The App uses your device's location to enable venue discovery and proximity features. Location is accessed only while the App is in use (foreground only). You can revoke location permission in your device settings at any time, though some location-dependent features will be limited.
8. Intellectual Property
The Services are licensed, not sold. We grant you a limited, non-exclusive, non-sublicensable, non-transferable, revocable license to use the App on your personal device for personal, non-commercial purposes. We retain all right, title, and interest in the Services, including their content, design, software, trademarks, and all related intellectual property, other than your User Content and third-party content. You may not copy, reproduce, distribute, modify, or create derivative works from the Services without our express written permission. Any feedback or suggestions you provide may be used by us without restriction or compensation.
9. Venue & Menu Information
We strive to keep venue information useful but make no representations about the completeness or reliability of any venue data (hours, deals, addresses, menus, dietary labels, or nutritional information). Menu items and dietary tags are provided by partner venues and have not been independently verified by JumpIn Pitt. If you have food allergies or dietary restrictions, always confirm directly with the venue. Venue information may change without notice.
10. Third-Party Links & Services
The Services contain links to, and integrate with, third-party sites, apps, and services that we do not own or control. This includes, for example, event ticketing platforms (such as Eventbrite), reservation providers (such as OpenTable, Resy, and Tock), mapping and review platforms (such as Google), authentication and SMS providers, data-storage providers, and the Apple App Store and Google Play. When you tap such a link, you may be redirected to a third-party site or app, and we may append anonymous referral parameters to the URL so a partner can receive aggregate click counts; no personal information is transmitted in those parameters.
We do not control and are not responsible for third-party sites, apps, content, products, services, events, tickets, reservations, refunds, cancellations, capacity, pricing, or availability. Your use of any third-party service is governed by that provider's own terms and privacy policy, which prevail over this Agreement for that provider's components. Any dispute arising from a third-party service is solely between you and that third party.
11. Website Waitlist & Partner Inquiries
By submitting the waitlist signup form on the Website, you consent to receive launch updates and early-access communications at the email address you provide; you may unsubscribe at any time. By submitting a venue partnership inquiry, you authorize us to contact you regarding partnership opportunities. Data submitted via the Website is stored securely. See our Privacy Policy for details.
12. Termination
We may suspend or terminate your access at any time for violation of this Agreement or for any other reason at our sole discretion. You may stop using the Services and delete your account at any time. Upon termination, your license to use the Services expires immediately. Sections 5, 8, 14, 15, 16, 17, and 18 survive termination.
13. Disclaimer of Warranty
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" BY THE PROTECTED PARTIES, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. THE PROTECTED PARTIES DISCLAIM ALL EXPRESS AND IMPLIED WARRANTIES INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, TITLE, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.
THE PROTECTED PARTIES DO NOT WARRANT THAT THE SERVICES WILL BE ERROR-FREE, CONTINUOUSLY AVAILABLE, SECURE, OR THAT RESULTS OBTAINED FROM USE OF THE SERVICES WILL BE ACCURATE OR RELIABLE. THE PROTECTED PARTIES ARE NOT RESPONSIBLE FOR ANY DISPUTES BETWEEN YOU AND ANY VENUE, EVENT ORGANIZER, TICKETING OR RESERVATION PLATFORM, OR OTHER THIRD PARTY, AND ARE NOT RESPONSIBLE FOR THE QUALITY, SAFETY, ACCURACY, LEGALITY, OR ANY OTHER ASPECT OF GOODS OR SERVICES PROVIDED BY THIRD PARTIES.
14. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL ANY OF THE PROTECTED PARTIES BE LIABLE TO YOU FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOST PROFITS, LOST DATA, BUSINESS INTERRUPTION, PERSONAL INJURY, EMOTIONAL DISTRESS, OR DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICES, FROM ANY VENUE EXPERIENCE OR THIRD-PARTY EVENT, OR FROM ANY THIRD-PARTY GOODS OR SERVICES, EVEN IF THE PROTECTED PARTIES HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
THE TOTAL AGGREGATE LIABILITY OF ALL PROTECTED PARTIES, COMBINED, ARISING FROM OR RELATING TO THIS AGREEMENT OR YOUR USE OF THE SERVICES SHALL NOT EXCEED THE GREATER OF (i) ONE HUNDRED U.S. DOLLARS ($100) OR (ii) THE AMOUNTS YOU PAID DIRECTLY TO US IN THE TWELVE MONTHS PRECEDING THE CLAIM. THIS LIMITATION APPLIES REGARDLESS OF THE THEORY OF LIABILITY.
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you. In such cases, the Protected Parties' liability is limited to the maximum extent permitted by applicable law.
15. Indemnification
You agree to defend, indemnify, and hold harmless each of the Protected Parties from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to: (a) your use of or access to the Services; (b) your violation of this Agreement; (c) your violation of any law or any third-party right, including any intellectual property, privacy, or contractual right; (d) any User Content you submit, post, or transmit through the Services; (e) any dispute between you and any venue, event organizer, ticketing or reservation platform, or other third party; or (f) your interaction with any venue, including in-person attendance, food or beverage consumption, allergic reactions, or transportation to or from a venue.
16. Governing Law
This Agreement is governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflict of law provisions. Any disputes shall be resolved exclusively in the state or federal courts located in Allegheny County, Pennsylvania.
17. Changes to These Terms
We may update this Agreement at any time. Material changes will be communicated through the App or Website, and the "Last updated" date above will be revised. Your continued use of the Services after changes take effect constitutes your acceptance of the updated Agreement. If you do not agree to the changes, stop using the Services.
18. Miscellaneous
This Agreement, together with the Privacy Policy, constitutes the entire agreement between you and JumpIn Pitt regarding the Services. If any provision is found unenforceable, it will be reformed to the minimum extent necessary, and the remaining provisions will continue in full force. Our failure to enforce any right does not constitute a waiver. You may not assign your rights under this Agreement without our written consent.
19. Sponsored Content
The Services may display paid placements from partners, clearly labeled with a disclosure badge. The badge text may read “SPONSORED,” “EXCLUSIVE,” “FEATURED,” “PARTNER,” or a similar short word; regardless of which word is shown, the block is always a paid commercial arrangement. Sponsored events, tickets, and related purchases are provided by third parties and are subject to Sections 6 and 10. JumpIn Pitt is not responsible for event cancellations, ticket refunds, venue capacity, event quality, or any disputes arising from third-party event attendance, and all ticket purchases are governed by the selling platform's own terms.
